The Emaar NOC
Dubai Hills Estate villas and townhouses are managed by Emaar Community Management. Its FAQ for the community is direct: if you plan to build or redo a pool, log in to the community portal, choose Home Modifications and apply for an NOC.
Emaar's home modifications fact sheet lists building a swimming pool as a modification that needs an NOC. Your consultant or contractor usually prepares the documents. Expect to provide:
- a description of the works and photos of the garden as it is now
- the pool drawings: plan, sections and elevations
- the contractor's trade licence
Questions come back through the portal and by email, and the NOC is downloaded from the portal once it is approved and the fee is paid. Fees are listed in the portal at the time you apply.
The government approval
The Emaar NOC doesn't replace the authority approval. Under Dubai Law No. 2 of 2026, in force since 1 June 2026, every new pool, including one in a private villa, needs its plans and design approved by Dubai Municipality's Environment, Health and Safety Agency before construction. Emaar's guidance also points owners to Dubai Development Authority or Civil Defence approvals where they apply. Ask your consultant to confirm which authorities cover your address.
Before the contractor arrives
Once the NOC and approvals are in, apply for the contractor's entry permit. Emaar requires one for every contractor working on a property. Emaar's fact sheet also says any water pumped out of the excavation has to go to the storm water drainage system, not the community sewer, which is worth raising with the contractor when you compare quotes.
Custom plots
Emaar's fact sheet says the standard NOC service doesn't cover Dubai Hills plots. If your villa was custom-built on a plot, ask Emaar which process applies before you order drawings.
Questions from Dubai Hills Estate owners
Do I need Emaar's permission to build a pool in Dubai Hills Estate?
Yes, for villas and townhouses covered by Emaar Community Management. Its Dubai Hills Estate FAQ says any alteration to the villa has to be approved by Emaar, and pool works are applied for as a home modification in the community portal.
Does the Emaar NOC cover the government approval?
No. Since 1 June 2026 every new pool in Dubai needs its plans and design approved by Dubai Municipality's Environment, Health and Safety Agency. Emaar's guidance also tells owners to get any Dubai Municipality, Dubai Development Authority or Civil Defence approvals that apply before work starts.
I built on a Dubai Hills plot. Is the process the same?
Not necessarily. Emaar's home modifications fact sheet says its standard NOC service doesn't apply to Dubai Hills plots, so ask Emaar which route applies to a custom-built villa.
